Acknowledgment of Risks, Injury &
Obligations
I acknowledge that the activity I am to undertake is a dangerous activity and that by participating in it
I am exposed to certain risks.
I acknowledge and understand that whilst participating in such activity:
- I may be injured, physically or mentally or may
- My personal property may be lost or damaged.
- Other persons participating in such activity may cause me
injury or may damage my property.
- I may cause injury to other persons or damage their
property.
- The conditions in which the activity is conducted may vary
without warning.
- There may be no or inadequate facilities for treatment or
transport of me if I am injured.
- I assume the risk of and responsibility for any injury,
death or property damage resulting from my participation in the activity.
- I come to the gym at my own risk.
- To cancel my membership, I must give 14 days
notice.
COVID Regulations
If you have any symptoms regarding COVID-19 / Corona Virus, then we urge you contact us and isolate
yourself until you get a test.
Most common symptoms:
- fever
- dry cough
- tiredness
- Less common symptoms:
- aches and pains
- sore throat
- diarrhoea
- conjunctivitis
- headache
- loss of taste or smell
- a rash on skin, or discolouration of fingers or toes
Serious symptoms:
- difficulty breathing or shortness of breath
- chest pain or pressure
- loss of speech or movement
Seek immediate medical attention if you have serious symptoms. Always call before visiting your doctor or
health facility.
People with mild symptoms who are otherwise healthy should manage their symptoms at home.
On average it takes 5–6 days from when someone is infected with the virus for symptoms to show, however it
can take up to 14 days.
Release and Indemnity
I participate in the activity at my sole risk and responsibility. Where client is below the age
of 18yrs the father/ legal guardian agree to take on this responsibility, having had the risks explained to them
first and this form must be signed by them. If no signature is provided then services will be declined. I
release, indemnify and hold harmless In The Pink, its employees and trainers, from and against all and any
actions or claims which may be made by me or my property whether negligence, breach of contract or in any way
whatsoever.
Use of Photographs or Videos in Social Media and for Marketing Purposes
I understand that my photo may be taken from time to time and I may be included in videos. It is assumed
that by allowing your photo to be taken that you agree for these images to be used. If I do not wish my images to be
made public I will inform the gym management or group trainer.
Studio Etiquette
Appropriate clothing must be worn and towels must be used at all times whilst in the studio
Memberships are not refundable or transferable.
All equipment must be put back after use.
Each member must respect other studio users and behave in an appropriate manner at all times.
Membership details must be kept up to date and shown on request.
Shared studio access with a non-member will result in forfeiture of membership effective
immediately.
In The Pink reserves the right to rescind the rights of members not complying with the terms
and conditions of the membership.
You are required to cancel a class that you have booked but can not make it, you must cancel 3 or more
hours before the class to give a person on the waiting list a chance to take your spot. Failure to do so, that will
result in a no show will equal a 40dhs fine on your account that must be paid before your next class.
Fees
Membership fees are non-refundable upon cancellation or termination for any reason whatsoever.
The member shall provide Credit Card details for payment of all monthly paid memberships. If the
credit card becomes inactive or cancelled the member shall provide new credit card details immediately to In The Pink
and sign all documents in favour of In The Pink to process future payments. For payments that
default In The Pink will attempt to charge the card on a maximum of 3 further occasions. During this
time the member will be denied access until outstanding fees are paid.
Monthly unlimited membership fees are payable on the due date as specified and agreed on the application
form. Failure to use the gym will not affect his/her obligation to pay all his/her membership
fees.
All new membership are a recurring payment and will come out of your bank on the same date every month,
whether that is for unlimited or rolling class packs. (See below for cancellation policies)
No-Show Charge
No-show fees are a result of not showing up for a class and not letting us know, this fee is 40dhs and
must be settled before you can do another class. You have up to 3 hours before the class to cancel and give the next
person a chance to take the spot.
You will receive a reminder message the first time you don’t show for a session, but following this your
account will automatically be charged. If you’re card is not on file, you will not be able to book any future
sessions until the no-show charge is paid.
Cancellations
Different packages now have different cancellations policies and they are as follows;
Class Packs:
Require 14 days notice to cancel from the subscription
Unlimited:
Monthly - requires 14 days notice
3 Months - 14 days but only after the 3 months
6 Months - 30 days but only after 3 months
12 Months - 30 days but only after 6 months
If you want the membership to terminate before the end of the contract, then put your notice in before the
renewal date based on how many days are required, as stated above.
Suspensions / Paused Membership
Paused membership are dependant on the membership you have;
If you are still on the old membership you are no longer be allowed to pause your membership.
If you have a 6 or 12 month membership that you have paid upfront for, you are unable to pause your
membership at any time.
New unlimited memberships can be paused for 30 days in a 12 month period.
New class pack memberships can be paused for 30 days in a 12 month period.
Membership & Packages
Class packs are rolling monthly payment, but the credits do not roll over. However many you
purchase at the start are to be used in that coming month and then will renew the following month.
Unlimited packages give you full access to any and every class, as many as you'd like.
All members must register their attendance at the reception.
